1. The Parties
The Complainant is Pfizer, Inc., D. C. (“the Respondent”), of New York, New York, United States of America.
The Respondent is R. Lee of New York, New York, United States of America.
The matter is before the court on the Complainant’s motion to dismiss, the Respondent’s motion to transfer the case to New Jersey for oral determination, and the Complainant’s motion for summary judgment.

4. Parties’ Contentions
The Complainant contends that, by using the Cialis® mark, the Respondent is taking and distributing a mark for the Respondent to be registered and used as the trade name of Complainant.
